SUBJECT: a) Consideration of Amendment One to Tower Space License Agreement between the County of Lake and Lake County Sanitation District; and b) (Sitting as the Lake County Sanitation District, Board of Directors) Consideration of Amendment One to Tower Space License Agreement between the County of Lake and Lake County Sanitation District.
EXECUTIVE SUMMARY: The Lake County Sanitation District (LACOSAN) leases tower space from the County of Lake on Buckingham Peak to accommodate their communications equipment. The license agreement was executed in 2007 with Buckingham Peak, LLC (which the County became the successor to upon purchase of Buckingham Peak), and includes provisions that the license fee shall be adjusted upward each year by the either 4% or the Consumer Price Index established in the agreement, whichever was greater.

Earlier this year the Board of Supervisors considered a request from Lake County Community Radio to eliminate, or at least reduce, their monthly fee, which led to the Board of Supervisors direction to staff to revert the monthly fee to the original amount that was established in 2007. Subsequent to the Board of Supervisors meeting, Supervisor Sabatier requested staff to bring to the Board of Supervisors a similar license fee reversion for LACOSAN. The LACOSAN license fee established in the 2007 agreement was $3,600 annually, which has now escalated to $4,697. Staff is proposing a fee reversion to the original agreement amount of $3,600, with a fee evaluation every fifth year to ensure the fee is still adequate to cover County of Lake costs of managing the tower space. Utility fees will remain the same based on usage.

Staff is requesting that the Board of Supervisors and the Lake County Sanitation District Board of Directors both consider and approve this item.
