SUBJECT:                     Consideration of motion to approve the County’s good faith participation in the Lake Local Agency Formation Commission’s (LAFCo) proposed process outlined in its letter dated December 4, 2019, with respect to the City of Lakeport’s application for the South Main Annexation Project

 

EXECUTIVE SUMMARY:

As your Board is aware, a committee of your Board has been meeting with representatives of the City of Lakeport to negotiate in good faith regarding Lakeport’s intent to annex the South Main area.

 

On August 19, 2019, Lakeport submitted an application to the Lake Local Agency Formation Commission (LAFCo) for annexation of +/- 136.78 acres extending one mile south of the existing city limits along South Main and Soda Bay Road.

 

In a letter from LAFCo dated December 4, 2019 (attached), LAFCo has advised of its intent to complete its own fiscal analysis to be funded by the City.  After completion of the analysis, LAFCo intends to schedule a facilitated meeting of the parties with an independent facilitator regarding the annexation and its fiscal effects.  LAFCO is requesting that both parties agree to participate in good faith in the process.

 

Although requested to take action within thirty days of LAFCo’s letter, the County did not actually receive the letter until December 10, 2019.  With this in mind, staff has requested this agenda item within thirty days of the County’s receipt of LAFCo’s letter.
