Subject: (a) Consideration of confirming the order of the Sheriff/OES Director allowing local businesses temporary use of County property under certain conditions during State 2 of Governor Newsom’s plan for gradual reopening from the COVID-19 pandemic
(b) Consideration of Letter to CalTrans urging said agency to allow local businesses temporary use of state-owned properties for during State 2 of Governor Newsom’s plan for gradual reopening from the COVID-19 pandemic
Executive Summary: (include fiscal and staffing impact narrative):
As we enter the accelerated Stage 2 of Governor Newsom’s plan for gradual reopening of our local economy, with restaurants, for example, now having authority to reopen for outside dining, our Sheriff/Office of Emergency Services Director has used his authority to allow local businesses to temporarily use County property, subject to certain conditions. A copy of the Sheriff/OES Director’s Order is attached hereto as a point of reference. The cities of Clearlake and Lakeport have done the same within their jurisdictions.
(a) Pursuant to Lake County Code Chapter 6, Article 1, Section 6-5.2, in the event of a local emergency, the OES Director is empowered to make and issue rules and regulations on matters reasonably related to the protection of life and property provided such rules and regulations are confirmed at the earliest practicable time by the Board of Supervisors.
We are requesting our Board confirm the order of the Sheriff/OES Director.
(b) In addition, we are requesting our Board approve and send a letter to CalTrans to request said agency take similar action to support local businesses by allowing the temporary use of state-owned properties.
