Subject: Approve a Deed Notification Covenant for an Environmental Restriction on a Portion of Lampson Field and Authorize the Chair to Sign.
Executive Summary: (include fiscal and staffing impact narrative):
In December, 2018 the Department of Public Works (DPW) was required by the Central Valley Regional Water Quality Control Board to conduct a Closure Evaluation Report (Report) on property at the airport. This property was the former site of a fixed-base operator at the airport called Air Power, Inc., which operated at the site from 1977 to 2009. This site has been the subject of extensive evaluation, monitoring and mitigation efforts since 1995. The Report was the result of groundwater testing performed by the state in 2017 and 2018, which showed continued presence of contamination of the groundwater. DPW hired a consultant to prepare the Report, and they have recommended the recordation of a Deed Notification Covenant to reduce the risk of exposure to residual contamination in the future. I have attached a copy of the draft Report for your information, along with a copy of the proposed Covenant.
This Covenant will only apply to a portion of the overall property at Lampson Field, which is illustrated on the attached map, and it simply restricts the use of groundwater to non-consumptive uses only.
