Subject:                     Consideration of Direction to the Registrar of Voters, regarding the Referendum Against Ordinance No. 3097, “An Ordinance of the County of Lake to Provide for Graduated Levels of Enforcement of Public Health Orders Through Education and Training and the Imposition of Administrative Fines”, adopted by your Board on August 18, 2020

 

Executive Summary: (include fiscal and staffing impact narrative):

On September 16, 2020, as Clerk of the Board, I received the referendum petition against Ordinance No. 3097.  The petitioner indicates that said petition consists of 381 sections and a raw count of 2,507 signatures of local registered voters.  The petition was received prior to the effective date of Ordinance No. 3097.  This means that the ordinance is presently suspended and the Board of Supervisors must reconsider the ordinance.  Your Board will likely wish to file the petition with the Registrar of Voters in order for the Registrar to verify the signatures. 

 

The Registrar of Voters has 30 working days from submission to verify the signatures, in order to determine if the petition is sufficient.  If the petition if found to be sufficient, the Registrar of Voters will certify the results to your Board at which time your Board must either rescind the ordinance in its entirety or present it to the voters.  If the petition is determined to be insufficient, no further action is taken and the Ordinance would go into effect.
