Subject: (Sitting as the Board of Directors for the Lake County Watershed Protection District) (a) Waive the formal bidding process, pursuant to Lake County Code Section 38.2 (2) & (3), as it is not in the public interest due to the unique nature of the goods or services and its determined that competitive bidding would produce no economic benefit to the County. (B) Approve the Agreement between the County of Lake and EOA, Inc. environmental consulting firm in the amount of $104,000 to provide assistance to meet NPDES storm water permit and TMDL compliance and to authorize the Chair of the board of Directors to sign the Agreement.
Executive Summary: (include fiscal and staffing impact narrative):
Attached for your approval, is the agreement between Lake County Watershed Protection District and EOA, Inc. to provide storm water permit and Total Maximum Daily Load (TMDL) compliance services. Approval of this agreement will allow the County of Lake, and the two storm water co-permittees, the City of Lakeport and Clearlake, to satisfy current and outstanding storm water compliance deadlines. This item is not expected to be controversial and this agreement is recommended by the seven-member Clean Water Management Council as high priority items needed to help address high priority water quality issues.
EOA, Inc. wrote the original 2003 Lake County Stormwater Management Plan, has an intimate knowledge of the joint program between the County and two cities, has an excellent working relationship with district staff, and has the required expertise to assist the County in satisfying NPDES permit compliance and outstanding TMDL requirements. Additionally, due to the nature of the co-permittee joint agreement between the Watershed Protection District, Lake County and two cities, it would not be in the best interest of the District, The County, or either city to embark into a cumbersome bid process that would not provide an economic benefit.
