Subject: Consideration of an Amendment to Chapter 25 - Floodplain Management of the Lake County Code. Requesting that the Board Waive the reading of the Ordinance to have it Read in Title Only and to Advance the Ordinance for a Second Reading at the Next Available Board Meeting
Executive Summary: (include fiscal and staffing impact narrative):
In March of 2019, the California Department of Water Resources (DWR) completed a Community Assistance Visit to evaluate Lake County’s compliance with the National Flood Insurance Program. As a result of that inspection, DWR has made several recommendations to improve our program, including updating the County’s floodplain management ordinance. In 2020, during an annual recertification of the County’s Community Rating System, FEMA noted that the ordinance also lacked specific freeboard requirements for machinery and equipment. Today’s item presents the recommended modifications to Chapter 25 of the Lake County Code.
A summary of the additions is as follows:
- Code of Federal Regulations (CFR) Section 65.3 requirement to notify FEMA within 6 months of availability of technical or scientific data for changes in base flood elevation.
- CFR Section 60.3 (b)(3) requirement to provide the base flood elevation for development of the subdivisions greater than the 50 lots or 5 acres with an approximate Zone A.
- CFR Section 60.3 (d)(3) requirement for hydrologic and hydraulic analyses for development within a regulatory floodway.
- Add language to require all machinery related to a structure be elevated to at least one (1) foot above the Base Flood Elevation.
Water Resources Department prepared the amendments to the Chapter 25 of the County Code to meet the DWR requirements. The revised code language is attached.
