Subject: Approve Amendment No. 4 to the Tower and Ground Space Agreement on Mount Konocti with AT&T and US Cellular

Executive Summary: (include fiscal and staffing impact narrative):
Your Board will recall that there are two communications towers on Mount Konocti Buckingham Peak. One tower is owned by the County, while the other is owned by AT&T but resides on ground space owned by the County. US Cellular occupies a portion of AT&T's tower as a tenant and, under the terms of the Tower and Ground Space License Agreement executed in 2002, the County receives 50% of the rent paid to AT&T by US Cellular for their use of the tower space.

Since 2002 the Agreement has been amended several times to facilitate US Cellular's antenna upgrades. When such upgrades increase the tower load (thus reducing tower capacity), a rent increase is justified. US Cellular recently completed upgrades to their tower equipment which triggers such an increase.

Attached for your Board's consideration is the fourth amendment to the Agreement which provides for a monthly rent increase of $363.41 to be paid to the County in consideration of US Cellular's upgrades and makes other minor changes.
