Subject: Request for Recommendation(s) to the Board of Supervisors regarding Early Activation of Use (EA) Permit for Cannabis Cultivation Activities

Executive Summary:
On July 19, 2022, the Lake County Board of Supervisors passed a Resolution and Interim Urgency Ordinance implementing a temporary moratorium on the issuance of Early Activation of Use permits for commercial cannabis cultivation. Additionally, the Board requested the Cannabis Ordinance Task Force and Planning Commission provide them with recommendations regarding amendments to the Zoning Code relating to Early Activation of Use Permits.

On August 1, 2022, the Cannabis Ordinance Task Force held a meeting to discuss recommendations on sections of the Lake County Zoning Ordinance relating to Early Activation of Use. There was consensus in the Task Force to recommend the following to the Board of Supervisors:

* Rescind the Early Activation Permit text from the Zoning Ordinance, as it pertains to cannabis; and

* Establish a mechanism that allows cannabis permit applicants to obtain a Conditional Letter of Authorization and Compliance from the County of Lake that would enable them to pursue both County and State License(s) simultaneously, with no cultivation allowed until approval from both jurisdictions takes place. Examples of letters are included as Attachments 1 and 2.
