Subject: WITHDRAWN - PUBLIC HEARING (a) Consideration and Presentation of the Fire Mitigation Fee Nexus Study; and (b) Consideration of Ordinance Amendment to increase Fire Mitigation Fees

Executive Summary:

Staff requests this item be withdrawn to obtain further information as it relates to County of Lake Code - Chapter 27 Mitigation Fees, Article I - Fire Mitigation Fees.

The purpose of this Article is to implement the Lake County General Plan policy providing for the adoption of fire mitigation fees and for the collection of said fees at the time of the issuance of building permits, said fees to be allocated to the affected Fire Agency for the acquisition of capital facilities in order to ensure the provision of the capital facilities necessary to maintain current levels of fire protection services necessitated by new development.

AB 1600 was adopted and codified in California Government Code ? 66000 allowing the establishing, increasing, or imposing of a mitigation fee as a condition of approval for new development where the purpose and use of the fee were identified and reasonable relationship to the development project was demonstrated.
