Subject: Consideration of Amendment No. 3 to the Agreement Between the County of Lake and the Smithwaters Group in the amount of $210,000 for Patient Rights Advocacy Services for Fiscal years 2022-23, 2023-24, and 2024-25

Executive Summary: The parties now desire to amend the Agreement a third time to increase the total compensation payable under the Agreement by $75,000.00 for a new contract maximum of $210,000.00 and must amend item three, "Compensation," to reflect this change.

This increase is due to the an increase in services brought about by California Assembly Bill 2275, which now requires a certification review hearing to be held within 7 days of the date the person was initially detained and would require the person in charge of the facility where the person is detained to notify the detained person of specified rights. The County Mental Health Plan is required to have a Patient's Rights advocate and the Patient's Rights Advocate is required to be present at these hearings.

It should also be noted that this increase is presently accounted for in our budget projections.
