Subject: (Sitting as the Board of Directors, Lake County Watershed Protection District) Adopt Amendment to Resolution 2022-116 Authorizing the Lake County Watershed Protection District Board Chair to execute a Lease Agreement between the Lake County Watershed Protection District and the Scotts Valley Energy Corporation

Executive Summary:

On September 20, 2022 your Board, sitting as the Board of Directors for the Lake County Watershed Protection District (District) adopted Resolution 2022-116 leasing property owned by the District to the Scotts Valley Energy Corporation (SVEC).

Since September 20, 2022, SVEC has been awarded grant funding from Economic Development Administration's (EDA) Indigenous Communities Program to fund the purchase of equipment for a waste woody biomass depot to process and transform forest thinning biomass from our region into saleable wood products. This project will render strong economic and forest fire related safety benefits to Lake County.

The EDA requires the lease to be filed with the deed to the property. In preparation to do so, a typographical error was discovered on the executed lease. This amendment corrects that error.

Original Lease:
V. COMPLIANCE WITH ALL FEDERAL, STATE, AND LOCAL LAWS
2. SCOTTS VALLEY shall be solely responsible for ensuring that all environmental compliance requirements of state and federal law are met and the Leased Property shall be used by SCOTTS VALLEY as described herein unless and until such environmental compliance requirements are met.

Amended Lease:
V. COMPLIANCE WITH ALL FEDERAL, STATE, AND LOCAL LAWS
2. SCOTTS VALLEY shall be solely responsible for ensuring that all environmental compliance requirements of state and federal law are met and SCOTTS VALLEY's use of the Leased Property shall be subject to meeting all permit and environment...
