SUBJECT: (a) Approve Amendment One between the County of Lake and Lake Indigent Defense for Public Defender Services to provide for its Termination effective January 31, 2018, and authorize the Chair to sign; and (b) Approve Agreement between the County of Lake and Lake Indigent Defense for Public Defender Services from February 1, 2018 through June 30, 2019 paid in monthly installments of $110,000, unchanged from the original agreement, and authorize the Chair to sign.
EXECUTIVE SUMMARY:
(a) The current Public defender services are provided pursuant to a contract with two local attorneys, whose partnership conducts business as Lake Indigent Defense. The recent appointment of Mr. Markham to the Superior Court Bench, necessitates his withdrawal from the partnership and Lake Indigent Defense has requested that Mitchell Hauptman be recognized as the new partner.
(b) In order to facilitate this transition, staff is recommending that the existing contract be terminated and a new contract, reflecting the partnership of Ms. Sullivan and Mr. Hauptman, be concurrently approved.
This approach also affords the opportunity to extend the contract expiration date, which is currently scheduled from May 6, 2017. In fact, Ms. Sullivan and Mr. Hauptman have agreed to extend the contract expiration date to June 30, 2019.
