SUBJECT: (Sitting as the Lake County Watershed Protection District Board of Directors) (a) Waive the formal bidding process, pursuant to Lake County Code Section 38.2, as it is not in the public interest due to the unique nature of the goods or services and; (b) Approve the Agreement between the County of Lake and Paragon Partners, Ltd. In the amount of $103,400.00, for Property Acquisition Services for the Middle Creek Flood Damage Reduction and Ecosystem Restoration Project and authorize the Chair of the Board of Directors to sign the Agreement

EXECUTIVE SUMMARY:
The Lake County Watershed Protection District (District) recently entered into a funding agreement with the State of California for fifteen (15) million dollars to be used for property acquisition as part of the Middle Creek Flood Damage Reduction and Ecosystem Restoration Project (Project). These funds will be used to purchase property from willing sellers that will be affected by the Project. For the few remaining residential properties, which are a top priority with this round of funding, relocation assistance will be provided as part of these purchases. The District has already spent nearly $10.2 million dollars on property acquisition using the services of Paragon Partners, Ltd. and staff proposes that they be retained to complete the additional purchases.
Paragon Partners, Ltd. (Paragon) was originally hired in October, 2012 following the County's Consultant Selection Process wherein three consultants submitted proposals. Paragon was selected as the most qualified firm. Five (5) Amendments to their original contract were made between 2012 and 2016, with Amendments 1, 3, and 5 adding additional scope and funding to their contract.
