Subject: (Sitting as the Board of Directors for the Lake County Watershed Protection District) (a) Waive the formal bidding process, pursuant to Lake County Code Section 38.2, as it is not in the public interest due to the unique nature of the goods or services, and (b) Approve the Agreement between the County of Lake and Monument Inc. for appraisal and acquisition services for the Middle Creek Flood Damage Reduction and Ecosystem Restoration Project and authorize the Chair of the Board of Directors to sign the Agreement

Executive Summary: (include fiscal and staffing impact narrative):
Waiving the formal bidding process pursuant to Lake County Code Section 38.2, your Board approved an agreement on September 17, 2019 with Paragon Partners Ltd. (Paragon) to provide appraisal and relocation assistance services for the Middle Creek Flood Damage Reduction and Ecosystem Restoration Project for eight (8) priority parcels within the Project area. The September 17, 2019 Paragon Agreement was signed while long-time Project Manager, Jeremy Nied, was with the firm. Mr. Nied was Project Manager for the appraisal and acquisition services for the Middle Creek Project for six (6) years. Shortly after signing the Agreement, Mr. Nied left Paragon Partners Ltd., to work with Monument Inc., Right-of-Way Services.

In addition to the eight (8) priority parcels in the Project area that Paragon is currently in the process of conducting appraisal and relocation assistance services for, there are forty-six (46) parcels in the Project area that need to be acquired not outlined in the current Agreement.
